Terms of Use
1. Purpose and acceptance
These General Terms of Use (the “Terms of Use”) govern access to and use of the kaissa.net website and the Kaissa application (the “Service”), published by Pionics, an SAS with a share capital of 5,000 euros, RCS Toulouse 938 387 768, 31 rue de Cugnaux, Bâtiment B, Appartement 66, 31300 Toulouse (“Pionics” or “we”).
Creating an account constitutes full and complete acceptance of the Terms of Use. Paid plans are additionally governed by the Terms and Conditions of Sale. The processing of personal data is described in the Privacy Policy.
2. Definitions
- User: any person with an account on the Service.
- Username: public name chosen by the User, visible to other Users.
- Game: a chess game imported or entered by the User, with its annotations and analyses.
- Collection: a folder in which the User stores their Games; Collections make up their personal database and are private.
- Study: a working board created by a User, containing positions, games and comments, which they can keep private or share with other Users or a Team.
- Team: a collective space bringing together several Users under the management of one or more Administrators.
- Professional Account: a paid plan giving access to advanced features, subscribed to individually or assigned via a Team.
3. User account
3.1 Access conditions
The Service is reserved for persons aged at least 15. By creating an account, the User declares that they are at least 15 years old. Pionics may suspend any account whose holder turns out not to meet this condition.
3.2 Registration
Registration is done by email and password, or via a Google account. The User provides accurate information and keeps it up to date. A person may hold only one account, unless authorised by Pionics.
3.3 Security
The User is responsible for keeping their login credentials confidential and for any activity carried out from their account. They shall inform Pionics without delay at contact@kaissa.net of any unauthorised use.
3.4 Account deletion
The User may delete their account at any time from their settings. Deletion results in the erasure of their private Games and Studies within the periods set out in the Privacy Policy. Ongoing subscriptions are governed by the Terms of Sale.
4. Description of the Service and plans
Kaissa makes it possible to import, analyse, annotate and organise chess games (collections, tags, Studies), explore public databases, prepare for an opponent, memorise openings, play against the computer (Sparring), dictate a game, follow tournament broadcasts and work as a Team. The features are described in the user guide (kaissa.net/guide).
The Service includes a free plan and a paid Professional Account. The features and limits of each plan (number of games, analyses and Studies, analysis depth, etc.) are those displayed on the website at the time of use. Pionics may change them under the conditions of article 14.
Engine analysis runs, at the User's choice, either in the User's browser (Stockfish, no data sent) or on Kaissa's servers, which then receive only the position being analysed. Sparring uses an engine developed by Pionics and third-party neural networks (Maia, Leela Chess Zero), downloaded once into the browser and credited in the Legal Notice; their results are provided for information purposes only.
5. User content
5.1 Ownership
Games, annotations, Studies and other content created or imported by the User remain their property. The User grants Pionics a non-exclusive, royalty-free, worldwide licence to host, reproduce, adapt and display this content solely to the extent necessary to provide the Service, for as long as it is stored on the Service.
5.2 Private by default
Imported Games and Studies are private by default. Only the User has access to them, unless they choose to share them (article 6). The Username is visible to other Users.
Deleted Games are placed in a trash that is emptied automatically after 30 days; after that period, they can no longer be recovered. The User may export their Games and collections in PGN format at any time.
5.3 Responsibility for content
The User is solely responsible for the content they import, create or share. They warrant that they hold the necessary rights, in particular over games imported from third-party platforms, and shall refrain from posting any content that is unlawful, defamatory, abusive or discriminatory, or that infringes privacy or the rights of third parties. This rule applies in particular to the Username, to Team and Study names, and to comments.
Pionics does not review content in advance. Any unlawful content may be reported to contact@kaissa.net; Pionics may remove it without notice.
6. Sharing and Studies
The User may share a Study with other Users, identified by their Username or email address, or with a Team of which they are a member. Recipients then access the Study according to the rights granted (read or edit).
The User who shares a Study remains responsible for its content and freely chooses its recipients. They may withdraw a share at any time; recipients then lose access, without prejudice to any copies they may have made.
A User invited to a Study undertakes not to disseminate its content outside the Service without its author's consent.
7. Teams
7.1 Creation and membership
Any User may create a Team and become its Administrator. A User may belong to several Teams. Membership is by invitation from the Administrator; the User may leave a Team at any time from their settings.
7.2 What the Administrator sees
The Administrator has access to members' Usernames and email addresses, as well as the status of their Professional Account. They do not have access to members' Games, analyses or Studies, unless members share them with the Team. The Administrator uses this information solely for managing the Team.
7.3 Team Licences
The Administrator may assign a Professional Account to Team members, billed in accordance with the Terms of Sale. Withdrawing a licence or leaving the Team returns the member to the free plan; their Games and Studies remain theirs, within the limits of the free plan.
7.4 Responsibility
The Administrator is responsible for managing their Team, for compliance with these Terms of Use by the people they invite, and for the content shared in the Team's space. Pionics may suspend a Team in the event of a breach.
8. Rules of use
The User uses the Service in accordance with its purpose: analysing and improving their chess. In particular, they shall not:
- access the Service by automated means (bots, scripts, scraping) or extract data on a large scale, except through a feature provided for that purpose;
- circumvent the limits of the free plan or of the Professional Account, or share their login credentials;
- disrupt the operation of the Service, attempt to access data or accounts that are not their own, or test its security without written authorisation;
- use the Service to cheat in a game in progress, online or over the board, in breach of the rules of the platform or organiser concerned;
- impersonate another player, choose a misleading Username or harass other Users;
- resell or sublicense access to the Service.
Pionics may apply reasonable technical limits (request frequency, import volume) to preserve the quality of the Service for everyone.
9. Broadcasts and third-party sources
The “Live” section displays public tournament broadcasts made available by their organisers or by third-party platforms. Pionics guarantees neither their completeness, nor their accuracy, nor their continuity, and is not affiliated with the organisers. Any rights holder may request the removal of a broadcast at contact@kaissa.net.
The public databases offered in the Service bring together publicly accessible games from tournaments and platforms. They can be consulted read-only and may be copied into your drafts for personal study. Their large-scale extraction or redistribution is prohibited. The preparation feature makes it possible to group the public games of a named player; it is reserved for competitive preparation and must not be used to harass, profile or harm that player. Any player may request information about their games or their anonymisation at rgpd@kaissa.net; the request is examined in light of the public nature of the game, under the conditions set out in the Privacy Policy.
Importing games from third-party platforms (Lichess, and Chess.com where this option is offered) uses their public interfaces, one-way. The User complies with the terms of use of these platforms; Pionics cannot be held liable for any unavailability of, or change to, their services.
10. Intellectual property
The Service, its code, interface, trademark, logo and databases are the property of Pionics or its partners. The User has a personal, non-exclusive and non-transferable right of use, limited to the lifetime of their account. Any unauthorised reproduction, extraction or exploitation is prohibited.
The Stockfish engine is free software distributed under the GPL v3 licence; its terms are set out in the Legal Notice.
11. Availability, changes and liability
Pionics makes its best efforts to ensure the availability and security of the Service, without guaranteeing that it will be uninterrupted. The Service may change: features may be added, modified or removed, with reasonable notice where a removal substantially affects paying Users.
Pionics is bound by a best-efforts obligation. It is not liable for Users' content, third-party services or indirect damage. Nothing herein limits Pionics' liability towards consumers beyond what the law permits.
The User is advised to keep a copy of their games; Pionics offers an export of their data in a standard format (PGN).
12. Suspension and termination
In the event of a breach of these Terms of Use, Pionics may, depending on its seriousness, warn the User, remove content, temporarily suspend the account or, after a formal notice that has remained unheeded for eight days, terminate it. In the event of a serious breach (fraud, compromising security, manifestly unlawful content), suspension may be immediate.
The User is informed of the reasons by email and may submit their observations to contact@kaissa.net. Termination for breach does not give rise to any refund of periods already paid.
Accounts inactive for more than three years may be deleted after one month's notice by email.
13. Personal data
Pionics processes Users' personal data in accordance with the GDPR. The purposes, retention periods, recipients and data subjects' rights are detailed in the Privacy Policy. Requests relating to data should be sent to rgpd@kaissa.net.
14. Changes to the Terms of Use
Pionics may amend these Terms of Use. Users are informed by email or by a notification in the Service at least fifteen days before a substantial change takes effect. Continued use of the Service after that date constitutes acceptance; a User who refuses may delete their account.
The version in force is the one published on the website, with its date of last update.
15. Governing law, mediation and jurisdiction
These Terms of Use are governed by French law. Any complaint should first be sent to contact@kaissa.net; Pionics responds within thirty days.
In accordance with the provisions of the French Consumer Code concerning “the consumer dispute mediation process”, after contacting us and in the absence of a satisfactory response, the consumer may use a consumer mediation procedure free of charge with:
